All new dealer accounts are subject to approval by Milestone Bath Products. Dealers must complete and submit the New Dealer Account Setup Form, including all required documentation. Milestone Bath Products reserves the right to reject any application without providing a reason.
Payments for all orders are processed in our online ordering system or over the phone. Orders are processed when paid in full.
Prices are subject to change without prior notice. Orders will be invoiced at the prices in effect at the time of order placement. All orders are subject to acceptance by Milestone Bath Products. Dealers must provide accurate purchase orders specifying quantities, product codes, and delivery instructions.
Milestone Bath Products will make reasonable efforts to deliver products within the agreed timeframe. However, delivery dates are estimates and not guaranteed. Risk of loss passes to the dealer upon delivery to the carrier.
Orders are processed immediately after a payment is successfully completed. Making changes to items, or cancelling orders will not be possible for any items that are special order. Milestone reserves the right to accept or reject changes to orders once they have been processed. Stocked Products (as noted in our catalog) that have not shipped can generally be changed or cancelled and restocked at no additional restocking fee. Special Order Products cannot be cancelled or restocked once an order payment has been processed.
Inspect all shipments immediately upon receipt. Take a photo of the pallet in addition to the packages. Note any damages or have the delivery driver note the damages on the bill of lading. If damages are not noted, shipping companies' terms may automatically assume the shipment was received in good condition. Mark "received but not inspected" on the bill of lading if an immediate inspection is not possible.
Take photographs of any damages to the shipment. Include a photo of the pallet (should have been done on arrival). Report the damages to us within 5 days of receipt to allow us to file a shipping claim. Submit an RMA through our system immediately with photos and details. Keep all material until we advise you can dispose of it as we may need it returned. Expect any replacement material will come on your next regular order. You should not book an installation date before you receive and inspect the material. Our customers generally have regular shipments going out which provides enough time for replacements to arrive in a timely manner.
If a claim is denied or cannot be submitted, Milestone Bath Products Inc. will not accept returns for the damaged goods.
As the manufacturer of the acrylic wall surrounds, shower floors/bases, and acrylic accessories, Milestone Bath Products warrants its Bellastone™ Products will be free of material defects for as long as the residential Customer owns the home where the Product was installed. For commercial/non-residential Customers, the term of the warranty is five (5) years. This warranty excludes any warranty for claims relating to installation/labor of Bellastone™ Products. This warranty is for product defects only. The warranty is non-transferrable. Milestone Bath Products does not warrant any non-Bellastone™ manufactured products.
Milestone warrants that the surface of the Bellastone™ acrylic products will not materially fade, yellow, crack, bubble, or peel under normal use and when cared for under the guidelines set forth by Milestone. The warranty expressly prohibits the use of unapproved cleaners, and expressly excludes damage resulting from the use of the same. In addition, this warranty is void if damage is caused by contact with any of the following: dyes, paints, inks, certain cosmetics, or cleaning agents, abrasive pads, pigments, certain foods, paint remover, fingernail polish remover, solvents or other chemicals, cigarettes or other sources of extreme heat, or abuse of any kind whether intentional or unintentional.
Improper installation, cutting, drilling, or fastening into or onto wall systems, fading, yellowing, cracking where cut, peeling, and chipping are specifically not covered.
In the event of a failure of the Product under these terms, Milestone reserves the right to partially repair, completely replace, or provide a full or partial refund, whichever Milestone deems appropriate in its sole discretion.
This warranty is in lieu of all warranties, expressed or implied, and is, in fact, the only warranty in regard to wall surrounds offered by Milestone Bath Products. This warranty will be extended to systems which are installed utilizing only installation materials purchased from Milestone Bath Products and will be void if any other installation materials are used. In any event, Milestone Bath Products shall be responsible only for repairs or a refund not exceeding the total amount originally paid for the BellaStone system.
All other products supplied through Milestone Bath Products are warrantied through the manufacturer. Dealers can submit a return merchandise authorization (RMA) through our online ordering system. Once received, Milestone will take steps to assess the claim, determine a course of action, and effectuate repair or other remedy under the terms of the products under the warranty claim. Any warranty work is subject to then-current lead times and then-current product availability. Should the Milestone Dealer from which the customer originally contracted for service is no longer in business, or should the customer not be able to satisfactorily resolve a warranty issue with the Milestone Dealer, the Customer can make a warranty claim in writing with Milestone for Bellastone™ manufactured products.
Don’t book installation dates before you receive and inspect the material. See 6.2 RMA Documentation and Reporting. Follow only the BellaStone install method. Use only our install materials; use of anything else voids the warranty. Place your order within 72 hours of your sale to ensure timely shipping. As per section 6 above, inspect all shipments upon receipt.
The Bellastone™ Illusions Series acrylic walls are subject to advertising restrictions in the United States. Sales, installation, and standard sales activities like in-home sales and showroom sales are all permitted. The advertising restrictions of these products are limited to the following: Dealers are not permitted to advertise or display any Bellastone™ Illusions Series Products online or in trade show promotions. Dealers must cease any unauthorized advertising or display activities immediately upon notification. If a Dealer fails to cease advertising or display activities after three warnings, the Dealer will not be permitted to purchase Bellastone™ Illusions Series walls for a period of one year.
The use of this technology and the benefits of such use is strictly as a courtesy service to dealer purchasing products. We will not accept responsibly for any errors or omissions caused by the use of the technology, and reserves the right to cancel or terminate the use of technology if required.
As all prices are subject to change, we occasionally have to communicate price changes or availability issues to you after you place your order and your order may be put on hold. Your receipt of an electronic order confirmation signifies our receipt of your order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.
In the rare event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge.
Either party may terminate this agreement with [specify number] days' written notice. Milestone Bath Products reserves the right to terminate the agreement immediately for breach of terms, including non-payment or violation of confidentiality.
Milestone Bath Products is not liable for any indirect, incidental, or consequential damages arising from the sale or use of its products. Milestone Bath Products' liability is limited to the replacement of defective products or the refund of the purchase price.
Dealers must promote their own business and must not present themselves as Milestone, BellaStone, or use the Milestone or Bellastone Brands in any promotions without prior written consent from Milestone Bath Products Inc.
Dealers are required to maintain a high level of customer service in their business operations. Dealers must provide any necessary customer warranty service as required, ensuring customers receive the support and assistance stipulated by Milestone Bath Products Inc.
Dealers must maintain a minimum of two million dollars in liability insurance. Dealers agree to hold Milestone Bath Products Inc. harmless in the event of any claim arising from their business activities.
Dealers must comply with all applicable local, state/provincial, and federal laws and regulations in the operation of their business.
These terms and conditions may be amended by Milestone Bath Products at any time, with notice provided to dealers.
